Barrhead to Larkfield to East Kilbride enhancement: EIR release

Information request and response under the Environmental Information (Scotland) Regulations 2004

Information requested

Geotechnical reports are mentioned in the above referenced letter between the Transport Minister Graeme Dey MSP and Collette Stevenson MSP. The following was quoted

“The geotechnical conditions between Busby and Hairmyres are challenging, and double-tracking would require significant earthworks to be undertaken, carrying a high degree of risk”.

I'm making an FOI request to receive copies of the reports that outline this statement please?

Response

Attached is a copy of Network Rail’s Project Earthworks Philosophy report dated August 2021. The purpose of this report was to set out the proposed earthworks philosophy for exploring the option of double tracking the section of the Barrhead to Larkfield to East Kilbride project.

An exemption under section 11(2) (Third party personal data) applies to a small amount of the information requested because it is personal data of a third party, i.e. names and contact details of individuals and companies, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018.

This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
