Information requested

You asked for information relating to FOI 2020000189 submitted to PHS. Specifically, you asked for:

  • Emails from/to the Cabinet Secretary for Health and Social and their staff, and any email attachments;
  • Internal meeting minutes, or reports;
  • Media briefing notes prepared by the Cabinet Secretary and/or government press office in case of approaches for comment by media outlets.

Response

Attached is a copy of some of the information you requested. We are unable to provide information relating to points 1 and 2 as we do not hold that information, as per S17.1 of FOISA. We have included information related to request 3 of your FOI, which was "Media briefing notes prepared by the Cabinet Secretary and/or government press office in case of approaches for comment by media outlets.".

An exemption under section 38(1)(b) of FOISA applies to a small amount of the information you have requested. This is because the information requested contains personal data of a third party, i.e. the names contact details and e-mail addresses of individuals, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
