Full content of all briefing notes, papers etc providing to the Cabinet secretary for Justice and Veterans and the minister for Community Safety in respect of their appearance before the Criminal Justice Committee of the Scottish Parliament on 1 September 2021.

Please find below some of the information you have requested. In response to your request, enclosed is an extract of some of the information requested in Annex A. While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because elements of the briefing you requested have been redacted under exemption in terms of section 30(b)(i) – free and frank provision of advice of FOISA applies to that information. This exemption is subject to the ‘public interest test’ and taking this into account we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption.

We have found, on balance, that the public interest lies in favour of upholding the exemption of specific elements of the briefing. We recognise that, in respect of some elements of the briefing, the public interest favours that the information is accessible. Accordingly, this information has been provided.
