Information regarding Port of Cromarty Firth (POCF): EIR release

Information request and response under the Environmental Information (Scotland) Regulations 2004


Information requested

1. The number of individual complaints made regarding the mooring of the Ocean Endeavour in Cromarty Firth in April-May of 2021.

2. The health and safety guidelines governing the use of Port of Cromarty Firth (POCF) including the regulatory requirements around environmental noise impact for both land and marine activities.

3. The map referred to in the 1973 enabling legislation that established the Port authority.

4. A list of all POCF ‘stakeholders’ as defined in the ‘Modern Trust Ports for Scotland - Guidance for good governance’ document.

5. A list of all current and planned POCF ‘Users’ for 2021-22.

Response

1. The Scottish Government has received one complaint regarding the mooring of the Ocean Endeavour in the Cromarty Firth in April-May of 2021.

2. The Port Marine Safety Code sets out a national standard for port marine safety in ports throughout the UK.

The Modern Trust Ports for Scotland: Guidance for Good Governance aims to encourage the continued development of an open and accountable relationship between all ports, their users and local communities.

Noise pollution is an issue for the relevant Local Authority, in this case Highland Council, to determine.

3. Due to Covid-19 workplace restrictions, it is currently not possible to access the hard copy documents stored in our office to determine if the Scottish Government holds a copy of this map. However, it is unlikely that we hold a copy of plans from 1973.

It may be held by the POCF, so you may wish to ask them for a copy.

4. Section 17(1) of FOISA (information not held) requires the Scottish Government to notify you if it does not have the information you requested.
