Enforcement notices served on fish farm sites: EIR release

Information request and response under the Environmental Information (Scotland) Regulations 2004

Information requested

Information with respect to specific correspondence from Mowi in relation to enforcement notices served on both the Grey Horse Channel and Colonsay fish farm sites.

In communications with you, ahead of receiving your request, it was confirmed that the enforcement notices relating to both of these sites had been complied with and the only further information held in relation to this issue concerned a communication from Mowi received in late March 2021. You asked for a copy of that correspondence within your request.

Response

I attach a copy of the information which you have requested.

An exception under regulation 11(2) of the EIRs (personal information) applies to a small amount of the information requested because it is personal data of a third party and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exception is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.
