Information request and response under the Freedom of Information (Scotland) Act 2002
Information requested
Data for the most recent available five years in the form of table 2(a) in the Criminal Proceedings in Scotland bulletin (“People proceeded against in court by main crime/offence and outcome of court proceedings”) but broken down further as follows:
(a) Please provide separate figures (for all categories) for solemn proceedings and for summary proceedings. (Effectively, two versions of table 2(a) – one for solemn proceedings and the other for summary proceedings – would be ideal.)
(b) Please, if possible, break down the “Charge proved” figure between cases where the accused pled guilty and cases which were proved at trial.
Response
(a) I attach a copy of the information (table 2a by solemn and summary proceedings) you requested in MS Excel format. Please note - tables do not include cases where the court is unknown.
(b) While our aim is to provide information whenever possible, in this instance the Scottish Government does not have some of the information you have requested. We are unable to break down the “charge proved” figure between cases where the accused pled guilty and cases which were proved at trial. The Criminal Proceedings database does not hold information on the plea, other than when a plea of not guilty is accepted.
