Compensation sums agreed when affected by the M8 (Baillieston to Newhouse) Special Road scheme: EIR review

Information requested

Full details of the compensation sums agreed by (or on behalf of) The Scottish Ministers with all claimants affected by the M8 (Baillieston to Newhouse) Special Road scheme to date. I note that the compensation paid concerning the M8 upgrade was released under an earlier FOI in 2017. I would be grateful for an update since that time with some additional information. The additional information is the rate per acre applicable to these compensation cases and the planning status / zoning the settlements were based on at vesting in 2013.

Response

I have concluded that the original decision should be confirmed with modifications.

Whilst an exception under regulation 11(2) applies to the instances where compensation has been paid to an individual, I don’t consider this exception applies where the compensation has been paid to a business or Limited Company as this information would not fall within the definition of personal data. I have attached a table showing the compensation paid to business or Limited Companies affected by the M8 (Bailieston to Newhouse) Scheme to date.

In relation to the additional information concerning the rate per acre applicable to these compensation cases and the planning status / zoning the settlements, I am satisfied that we were entitled to refuse this part of your request under regulation 10(4)(a) (information not held) for the reasons given in our initial response.
