Subject access request submissions to the Scottish Government: FOI release

You asked for:

In relation to the Data Protection Act 1998 legislation and the General Data Protection Regulation, can you please provide statistical data for subject access requests; requests to rectify personal data; and requests to erase personal data received by your organisation under the following headings between September 2016 and December 2019:

  • Number Upheld – Personal data provided / changed / delete

  • Number Returned – Requests returned due to insufficient information / request made on behalf of someone else etc.

  • Number Refused – Personal data NOT provided / changed / deleted

For awareness – an organisation must not refuse a valid data subject rights request, unless that request is manifestly unfounded or excessive. The Scottish Government has refused one request on those grounds during the time period considered.

All occasions where we have returned the request to the applicant it was for one of the following reasons; we did not hold any personal data, the request was for another organisation and the applicant wrote to us in error, or the applicant did not provide us with verification of their identity or information we required to enable us to locate their personal data.
