Information requested

1.  The total number of employees within Marine Scotland Compliance to date.

2.  The total number of male fishery officers to date in Marine Scotland Compliance.

3.  The total number of female fishery officers to date in Marine Scotland Compliance.

4.  The total number of foreign fishery officer/and or other nationality to date within Marine Scotland Compliance

5.  The total number of reported cases of bullying and harassment reported within Marine Scotland Compliance since April 1st 2009

6.  The total number of cases of bullying and harassment where employees were actually disciplined April 1st 2009

Response

[redacted s38], People Advice and Wellbeing Manager subsequently contacted you on 11 September 2019 to clarify what was meant by the use of the term ‘to date’ in your request.  You confirmed, on 13 September 2019, that by ‘to date’ you meant the numbers at this present time. 

You have asked for information about Scottish Government employees working within Marine Scotland Compliance Division.  This response therefore covers SG staff who are employed in the Marine Scotland Compliance Division.  The response to your request can be found in the attached annex.
The data provided in the annex for your first four points is taken from figures at the end of June 2019.  These are our most recent published figures. 
While our aim is to provide information wherever possible, I am unable to provide some of the information you have requested because an exemption under section 38(1)(b) of FOISA applies.  That exemption applies because the information is personal data of a third party/parties, and disclosing it would contravene the data protection principles set out in the General Data Protection Regulation (GDPR), Regulation 2016/679 and section 34(1) of the Data Protection Act 2018.

ANNEX
Responses to your requests

1.  The headcount for the total number of directly employed staff within Marine Scotland Compliance is 253.  This is based on the end of June 2019 published figures.

2.  The headcount for the total number of male fishery officers (B1 Fishery Officer) currently working in Marine Scotland Compliance is 34.  This is based on the end of June 2019 published figures.   

3.  The headcount for the total number of female fishery officers (B1 Fishery Officer) currently working in Marine Scotland Compliance is 12.  This is based on the end of June 2019 published figures.

4.  The headcount for the total number of foreign fishery officer/and or other nationality to date within Marine Scotland Compliance is fewer than 5.  This is based on the end of June 2019 published figures.  This number does not include individuals who have self-identified as ‘English’, ‘Welsh’ or ‘Irish’, or where an individual has not declared their nationality.

5.  The Scottish Government has robust policies and procedures in place to deal with occasions where expected standards of behaviour are not met.  There is no requirement to report informal action to HR and therefore no information is held centrally about cases that have been dealt with locally.  Since April 1st 2009, there have been 10 cases of bullying and harassment within Marine Scotland Compliance which were reported to HR.

6.  Since April 1st 2009, there have been 8 cases of individuals being disciplined due to bullying and harassment within Marine Scotland Compliance.

7.  Since April 1st 2009 there have been 19 employees dismissed from Marine Scotland Compliance.  These dismissals have been for various reasons. 

8.  The total number of employees that have been medical suspended with pay from Marine Scotland Compliance since April 1st 2009 is fewer than 5.

9.  The total number of employees that have been medical suspended without pay from Marine Scotland Compliance since April 1st 2009 is fewer than 5.
