Information request and response under the Environmental Information (Scotland) Regulations 2004.
Information requested
Schemes, opening dates, costs and contractors for A9 Killiecrankie to Calvine, Perth Western Bypass, Broomhill to Logie Easter, Logie Easter to Garrick Bridge and Greenloaning to Dunblane.
“Thank you very much for finding and providing the information to me. It has helped filled gaps in the Knowledge and your contributions will be noted.
I have found some schemes that I do not have information for and I would greatly appreciate the information being provided.
• A9 Killiecrankie to Calvine Stage 1
• A9 Perth Western Bypass
• A9 Broomhill to Logie Easter
• A9 Logie Easter to Garrick bridge
• A9 Greenloaning to Dunblane
All these schemes are stretches of new road except Greenloaning to Dunblane which was online upgrading from single to dual carriageway standard.”
Response
As the information you requested is ‘environmental information’ for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.
This exemption is subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.

In the table above, we have provided you with details of the A9 Killiecrankie to North of Calvine scheme but we are unaware of the A9 Killiecrankie to Calvine Stage 1 scheme. In addition, there was two Perth Western Bypass schemes and we have provided the ‘open to traffic’ dates for both.
While our aim is to provide information whenever possible, in this instance the we do not hold some of the information you have requested in relation to the Greenloaning to Dunblane scheme, information on the contractors for the schemes above, the costs and the completion dates. Therefore we are refusing your request under the exception at regulation 10(4)(a) of the EIRs.
