Information request and response under the Environmental Information (Scotland) Regulations 2004.

Mearns Community Council requests information about road traffic collisions, which resulted in injury or fatalities, on the A90 between Northwaterbridge and Glenbervie for the following time period from 2000 to date (26th March 2019).
In particular we’re looking for the junctions with roads to Edzell Woods; Luthermuir; Fettercairn; Marykirk; Laurencekirk; Auchenblae, Glenbervie and Drumlithie.
For each collision, we are seeking time and date; the number of people injured or whether there was a fatality; We would also like detail of the location - grid reference and latitude/longitude; and vehicle(s) involved.
As the information you have requested is ‘environmental information’ for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.
This exemption is subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.
In response to your request, please refer to Annex A of this request which details the personal injury accidents which occurred on the A90 between Northwaterbridge and Glenbervie and the vehicles involved for the period from 1 January 2000 to 30 January 2019. The table provided in Annex A provides a line entry for each vehicle type involved in an accident. Where there was more than one vehicle involved in an accident, the accident reference may be repeated over more than one line. Transport Scotland does not currently hold accident data for the period 31 January 2019 to 26 March 2019.
Annex B contains details of the information relating to casualty severity. As the table provided in Annex B provides a line entry for each casualty in an accident, where there is more than one casualty the accident reference may be repeated over more than one line.
