Information requested
 
All information held relating to ScotRail’s monthly performance monitoring publications. Specifically any information held which clarifies:
 
  • When Transport Scotland became aware that ScotRail was using internal rather than franchise targets in its publications
  • What action Transport Scotland took in response to discovering internal rather than franchise targets were being used in publications
  • Any information regarding Transport Scotland’s, or the Transport Minister’s consideration of whether this was a breach of the franchise

While our aim is to provide information whenever possible, in this instance Transport Scotland does not have the information you have requested. The reasons why we don’t have the information are explained below.

 

Reasons for not providing information
 

It is normal and appropriate for companies, including rail companies, to set internal targets for a variety of purposes. However, Transport Scotland does not hold such data where they are not contractual requirements. The ScotRail Franchise Agreement does contain contractual targets which ScotRail is required to achieve, and delivery of these is monitored regularly and appropriately by Transport Scotland. 

This is a formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested.
