Road traffic collisions, which resulted in injuries or fatalities, in Argyll and Bute: EIR release

Information request and response under the Environmental Information (Scotland) Regulations 2004.

FOI reference: FOI/18/02779
Date received: 3 October 2018
Date responded: 11 October 2018

Information requested

Information about road traffic collisions, which resulted in injury or fatalities, in the Lomond North, Helensburgh Central, and Helensburgh & Lomond South ward areas of Argyll and Bute Council, for the following time periods: 2014, 2015, 2016, 2017, 2018 to date. If the total data for these five years is too large for a single request, please split this into five separate requests, one for each year. If this is still too large, please then split it into a separate request for each ward for each year, i.e.15 requests in total.

For each collision, I am seeking just a statement as to the date; the number of people injured or whether there was a fatality; I am also seeking the location  - grid reference and latitude/longitude; and vehicle(s) involved.

Response

As the information you have requested is ‘environmental information’ for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations.  We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.

This exemption is subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.

I attach a file with the information you requested for wards within Argyle and Bute council. Information for accidents in 2018 is not available at the moment as it is still being collected from Police Scotland.
