Information requested
Details of any meetings or correspondence (emails, typed or handwritten notes, letters, phone calls, minutes of meetings, documents or otherwise) between Scottish Government ministers, senior civil servants or special advisers and Matthew Jury or any private citizens regarding the three Scottish soldiers murdered by the IRA in 1971.
Response
I enclose a copy of all of the correspondence held between Scottish Government ministers, senior civil servants or special advisers and private citizens regarding the three Scottish soldiers murdered by the IRA in 1971.
I have also enclosed a read out from a meeting between Cabinet Secretary for Economy, Jobs and Fair Work and Matthew Jury.
Some information has been redacted because exemptions under section 38(1)(b) of FOISA applies to that information. The reasons why these exemption(s) apply are explained below.
Reasons for not providing information
Information request and response under the Environmental Information (Scotland) Regulations 2004.
Section 38(1)(b) – applicant has asked for personal data of a third party.
An exemption under section 38(1)(b) of FOISA (personal information) applies to a small amount of the information requested because it is personal data of a third party, i.e. names and contact details and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
