Information requested
1. All sexual harassment complaints received by Scottish Executive/ Government from 1999 to current date; the number of complaints, and all details that can be disclosed;
2. All disciplinary procedures conducted by Scottish Executive / Government against staff which resulted in a verbal or written warning or termination of employment of staff - number and all details that can be disclosed, including payments at end of service;
3. All sexual harassment complaints received by UK civil service since 1979 to current date relating to UK civil service Scotland office; the number of complaints, and all details that can be disclosed including payments at end of service;
4. All disciplinary procedures conducted by UK civil service/ Scotland office against staff which resulted in a verbal or written warning or termination of employment of staff for gross misconduct since 1979 including payments at end of service.
2. All disciplinary procedures conducted by Scottish Executive / Government against staff which resulted in a verbal or written warning or termination of employment of staff - number and all details that can be disclosed, including payments at end of service;
3. All sexual harassment complaints received by UK civil service since 1979 to current date relating to UK civil service Scotland office; the number of complaints, and all details that can be disclosed including payments at end of service;
4. All disciplinary procedures conducted by UK civil service/ Scotland office against staff which resulted in a verbal or written warning or termination of employment of staff for gross misconduct since 1979 including payments at end of service.
Response
The first part of the information you have requested was provided in response to a recent Parliamentary Question. I have provided a copy of this at Annex A for information.
We have interpreted that the second part of your question relates to the first part and is seeking information on disciplinary procedures relating to sexual harassment complaints. Due to small numbers and to avoid possible disclosure of personal data under section 38 (1) (b) of FOISA (personal information), it is not possible to break down the number of disciplinary outcomes in the manner you have requested.
Our response covers staff employed on Scottish Government Main and Scottish Government Marine terms and conditions of employment and Senior Civil Servants employed in the following areas:
- Scottish Government Core Directorates
- Accountancy in Bankruptcy
- Disclosure Scotland
- Education Scotland
- National Records of Scotland
- Office of Scottish Charity Regulator
- Scottish Housing Regulator
- Transport Scotland
It does not cover any other UK Civil Service departments as requested in parts 3 and 4 of your request as we do not hold information in relation to other Civil Service departments. If you wish to request staffing information about other UK Civil Service departments you will need to contact those departments directly.
