Information requested
The highways boundary information for the roads included in the location map attached.

Please could we also have personal injury traffic accident data for the area shown.

Usually we would ask you provide:
· Plot of accident locations
· Date and time (Over a period of the last available 60 months)
· Weather and Lighting Conditions
· Number and type of vehicles involved
· Severity (Slight, Serious, Fatal) - (we only need injury accidents)
· An OS Grid reference
· Brief Description of what occurred
· And anything else you feel relevant

Response
As the information you have requested is ‘environmental information’ for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations.  We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA. 
 
This exemption is subject to the ‘public interest test’.  Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption.  We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes.  This is essentially a technical point and has no material effect on the outcome of your request.

To confirm, Transport Scotland are responsible for maintaining the Trunk Road Network including motorways. Local roads are the responsibility of the local authority. The information that has been provided within this response concerns the A96 only.

While our aim is to provide information whenever possible, in this instance Transport Scotland does not have the information you have requested in the first part of your request.  Therefore we are refusing your request under the exception at regulation 10(4)(a) of the EIRs.  The reason why that exception applies is that we do not hold road boundary information.

We have, however been able to provide a map of of our maintenance responsibility. This has been provided at Annex A.

Please refer to Annex B of this request which contains details of personal injury accident data over the period from 1 January 2013 to 30 March 2018, which is the latest data we hold.  Further information upon which the accident information is provided can be found in Annex B.

An exception under regulation 10(5)(a) of the EIRs (prejudice to international relations, defence, national security or public safety) applies to some of the information you have requested.  This exception applies because disclosure of this information would, or would be likely to, endanger the physical or mental health or safety of an individual.
