Response
While our aim is to provide information whenever possible, in this instance the Scottish Government does not have the information you have requested.
Disclosure Scotland does not hold information that will definitively state that an application for disclosure is for work in England and Wales. Since February 2018, where an individual needs a Basic Disclosure for a job in England and Wales they should apply to the Disclosure and Barring Service.
Disclosure Scotland holds information that identifies the applicant's home address - however, you may wish to note that an applicant with a current address in England and Wales does not necessarily mean that the work to which the disclosure relates is itself in England and Wales. It is possible that the individual may have applied for a disclosure for a role in Scotland but currently resides in England or Wales or vice versa. In addition, a Basic Disclosure is not solely for employment purposes and can be obtained by an individual for any purpose.
If you require this information to be provided on this basis (current country of residence), please advise by return e-mail.
With regard to the number of those applications from applicants whose current address is in England and Wales were for people working in the public sector or Government departments, unfortunately Disclosure Scotland do not hold this information. On a Basic Disclosure application, the employer field is not mandatory to complete – thus, in the overwhelming majority of cases, no information is available.
Where an application is for a Standard or Enhanced Disclosure (when the employer field is mandatory on the disclosure application) which relates to work in England and Wales, these types of applications can only be lawfully made to the Disclosure and Barring Service.
