Information requested
The full payment schedule for the AWPR/B-T project, in terms of the Scottish Government payments through its Non Profit Distributing model to the individuals or organisations undertaking the project/programme.
I would like the information to contain:
1. The payment period (in years) for the whole project and what payment year we are in now, relative to the start.
2. The amount of money paid every year so far, and scheduled to be paid in future years, including this year, until the project has been fully paid off.
Response
As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.
This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.
1. The Non Profit Distributing (NPD) contract for the Design, Build, Finance and Operation of the AWPR/B-T project was awarded to Aberdeen Roads Limited (ARL). As such, ARL is responsible for the funding, final design, construction and subsequent maintenance of the completed scheme for a period of 30 years on behalf of the Scottish Ministers. We are currently in payment year 3, with the first payment being made to ARL in 2016.
2. Please see table below containing details of the payments made to date, through the Non Profit Distributing model, relating to the Craibstone and Dyce junctions, which opened to traffic in August 2016:
