Capital expenditure budget for A77: EIR release

Information requested

The following information with regard to Transport Scotland for the last 10 years i.e. from 01/03/2008 to date.

1. A detailed breakdown of the Capital Expenditure budget for each year, for the A77 from Whittlets roundabout to Stranraer.

2. The percentage of the total capital budget for every Road Project in Scotland.

Response

As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.

This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.

1. We have applied regulation 10(4)(a) of the EIRs to the first part of your request regarding the Capital Expenditure for the A77 Whittlets to Stranraer. The reason why that exception applies is that these costs are part of a maintenance budget for the entire route and we are unable to breakdown by route area. We are however able to give you information in relation to Capital Expenditure for the A77. Regulation 10(4)(a) has also been applied as we only have maintenance figures up until 30 September 2017.

The total Capital Expenditure figure for 1 March 2008 to 30 September 2017 is £47,305,314.
