That there is a review of your decision (Previous Response) and ask for confirmation whether the data specified in the attached document is indeed held by the Children and Families Analysis Team in Education Analytical Services Division of the Scottish Government Learning and Justice Directorate.
Response
I have now completed my review of our response to your request under the Freedom of Information (Scotland) Act 2002 (FOISA) for Child Protection information relating to children born from 1st August 2012 to 31st July 2013 inclusive and covering events occurring before their 4th Birthday.
I have concluded that a different decision should be substituted. I enclose a copy of most of the information you requested. The spread-sheet attached provides a cover sheet, the data, and notes.
While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section 38(1)(b) of FOISA (personal information) applies to a small amount of the information requested because it is personal data of a third party, ie where the number of children is low enough to potentially lead to identification of individual cases, and disclosing it would contravene the data protection principles in Schedule 1 to the Data Protection Act 1998. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
I am satisfied that this constitutes all of the information held by the Scottish Government which falls within the scope of your request.
More broadly, as part of the child protection improvement programme, the Scottish Government is undertaking with partners a review of the current data and evidence landscape for child protection in Scotland that can be used by practitioners to inform thinking around prioritising, planning workforce and service improvement.
