Information requested

You asked for details of any briefings delivered to John Swinney or any Scottish Government ministers on the inquiries act 2005 from January to July 2016. Information should include any documents, dates and who they were sent to.

Response

I enclose all of the information you have requested at Annex A of this letter. Some names and contact details have been redacted because an exemption under Section 38(1)(b) (personal data) applies to that information. The reason why this exemption applies is explained below.

Reasons for not providing information

Section 38(1)(b) – applicant has asked for personal data of a third party:

An exemption under section 38(1)(b) of FOISA (personal information) applies to some of the information requested because it is personal data of a third party, ie names/contact details of individuals, and disclosing it would contravene the data protection principles in Schedule 1 to the Data Protection Act 1998. This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
