Information request and response under the Environmental Information (Scotland) Regulations 2004
Information requested
You asked for the following information in relation to road works on the A82 trunk road between Falls of Falloch and Tarbet on the evening of Thursday 24 April:
I would like to see the road closure authorisations for these works. I would like to see the risk assessment and, most importantly, the traffic management plan (including the signage) for these works. I would like to see and understand the contractual requirements on Contraflow Ltd for these works including their signage responsibilities. It strikes me that significant public funds are being spent on a company who are not fulfilling their contracts and who belittle and sneer at the misfortune of the public. If a more formal Freedom of Information request is required please advise - otherwise please accept this email as that request.
Response
As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.
This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.
Road Closure Authorisation
Please see Annex A to this response for a copy of the 'The North West Scotland Trunk Roads (Temporary Prohibitions of Traffic and Overtaking and Temporary Speed Restrictions) (No. 2) Order 2025. The road closures were carried out under this Scottish Statutory Instrument.
Risk Assessment
Please see Annex B to this response for a copy of the Risk Register for these works. An exception under regulation 11(2) of the EIRs (personal information) applies to some of the information requested because it is personal data of a third party and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exception is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.
Traffic Management Plans
Please see Annexes C-E to this response for a copy of the signage arrangements for these works. Contractual requirements on Contraflow Ltd for these works including their signage responsibilities
Contraflow are employed on a job-by-job basis as a subcontractor to our Operating Company BEAR Scotland, who provide traffic management services, including signage in line with Chapter 8 of the Traffic Signs Regulations. Contraflow deliver traffic management on the trunk road network as they are an approved contractor of both BEAR Scotland and Transport Scotland and have been delivering traffic management services across Scotland for over 15 years.
