Statement on David Davis claims

Scottish Government spokesperson responds to assertions made by David Davis MP in relation to documents provided to the court in the judicial review in the case of the former First Minister.

Commenting on assertions made in the House of Commons by David Davis MP in relation to documents provided to the court in the judicial review in the case of the former First Minister, a Scottish Government spokesperson said: 

“The assertions made by David Davis are wrong - this document was not withheld, it was provided to the Court on 21 November 2018.

“The Scottish Government absolutely refutes the allegation that civil servants sought to obstruct or show contempt for the court process.”

Background

The document was provided as part of a wider set of documents. A single redaction had been made in error within the document, redacting one email address. This issue is narrated in the note from counsel of 17 December 2018 (paras 6 through 22).
