Young performers licensing guide

Who this is for

This guide explains the licencing system that protects the welfare of young performers and participants in activities. 

This guide applies to individual child performing licences. It is for: 

• local authorities (licencing authorities) 

• licence holders (the applicant) – people who applied for a licence and are responsible for arranging professional or amateur performances, or for engaging a child or young person in a licensed activity 

• chaperones - people who safeguard children and young people involved in performances and other activities 

• private tutors 

• schools 

• parents and guardians 

Purpose of the licencing system 

The opportunity to perform on stage or screen or take part in sporting or modelling activities can benefit the wellbeing of children and young people. However, while participating in these activities, there is a need to ensure a child's safety and wellbeing are protected. 

Children involved in performances and other activities can be at risk, both to their immediate safety and longer-term wellbeing. 

Licensing puts safeguards in place, such as defined breaks and educational requirements to protect the children involved. 

Legislation 

The licencing system for child performances is based on:  

• Part II of the Children and Young Persons Act 1963.  

• Section 25 of the Children and Young Persons Act 1933 covers licences for children performing or taking part in activities abroad. 

• The main regulations are the Children (Performances and Activities) (Scotland) Regulations 2014, which have been in effect since 2015. These replaced the earlier Children (Performances) Regulations 1968 as they applied in Scotland. 

Ofcom’s role 

Television and radio broadcasters are regulated by Ofcom, an independent statutory regulator. The Ofcom Broadcasting Code includes rules to protect children who take part in programmes. These rules apply whether a licence is required or not. 

Ofcom has also published detailed guidance for broadcasters on how to apply the rules, including precedent cases.
