Stage 1: Framing

Results of framing exercise

There is significant evidence available in relation to the pupil population in Scotland. There is limited evidence on the transgender population in Scotland, including young people, however additional sources of evidence have been established since the revised guidance was originally established in 2021.

There is some evidence available in relation to transgender pupils and young people in the form of research undertaken by third sector and other interested organisations.

Extent/Level of EQIA required

It is considered that an updated partial EQIA is required for this work. The protected characteristics of age and marriage and civil partnership do not apply to schools. Impact has been assessed across all of the relevant protected characteristics and those most affected are:

  • Disability
  • Gender reassignment
  • Sex
  • Sexual orientation

The decision to develop revise the ‘Supporting Transgender Pupils in Schools Guidance’ is taken in light of legal decisions during 2025. The Child Rights and Wellbeing Impact Assessment (CRWIA) is also updated.
