Business and regulatory impact assessment (BRIA) for the Scottish Statutory Instrument (SSI) to add "sex" as a characteristic to the Hate Crime and Public Order (Scotland) Act 2021.
Introduction
This Business and Regulatory Impact Assessment (BRIA) accompanies the Scottish Statutory Instrument (SSI) adding the characteristic of ‘sex’ to the Hate Crime and Public Order (Scotland) Act 2021 (“the 2021 Act”) which was laid in Parliament on 28 January 2026.
It sets out the impact on business, public sector and third sector bodies of the addition of the characteristic of sex to the 2021 Act.
