Scottish Marine Recovery Fund: interim guidance
Interim guidance for offshore wind developers seeking information on the Scottish Marine Recovery Fund (MRF) prior to it becoming operational. The MRF will help to deliver a more streamlined process for securing compensation for adverse environmental effects of relevant offshore wind activities.
Definitions
Adverse impacts:
- where there is significant risk of an act hindering the conservation objectives of a Marine Protected Area under section 126 of the Marine and Coastal Access Act 2009 or under section 83 of the Marine (Scotland) Act 2010
- where a plan or project may adversely affect the integrity of a Special Area of Conservation or Special Protected Area under the Habitats Regulations
Compensation or compensation measures:
- compensatory measures under the Habitats Regulations
- measures of equivalent environmental benefit under the Marine and Coastal Access Act 2009 or the Marine (Scotland) Act 2010
Habitats Regulations:
- the Conservation (Natural Habitats, &c.) Regulations 1994
- the Conservation of Habitats and Species Regulations 2017
- the Conservation of Offshore Marine Habitats and Species Regulations 2017
Protected sites:
- Nature Conservation Marine Protected Areas, Demonstration and Research Marine Protected Areas, Special Areas of Conservation and Special Protected Areas
