This draft document is a point in time assessment of the likely effects of legislating to introduce qualifying requirements for religious and belief bodies with celebrants who solemnise marriages and register civil partnerships, on the rights and wellbeing of children and young people. It is intended to support engagement with the Scottish Government’s consultation on the qualifying requirements. The Scottish Government will continue to review and update this document where required during the decision-making and during any parliamentary process. Any future iterations will reflect an increased understanding of these impacts as the amount of evidence available continues to grow.

Scottish Government acknowledge the importance of monitoring and evaluating the impact of strategic decisions and legislation on children’s rights and wellbeing. Any information gathered during the consultation on the strategic decision to which this draft impact assessment relates to, will be used to inform future determinations of impact. Any new strategic decision or new legislation (including amending legislation) would be subject to a new CRWIA in line with the legislative requirements.
