Restorative justice: policy and practice framework
Guidance on the practice of restorative justice (RJ) in Scotland in relation to adults and children. It sets out minimum standards and expectations against which RJ practice can be benchmarked, monitored and evaluated to ensure consistent delivery in line with RJ principles.
25. Data and information sharing
25.1 The lawful basis for processing data will need to be determined on a case-by-case basis. Where consent is the basis for sharing data then facilitators will need to build in processes throughout the delivery of RJ services that meet the criteria as set out by the Information Commissioner’s Office[xxi].
25.2 Obtaining, reviewing and monitoring consent should include the following:
- A positive opt-in from all parties to the RJ
- A clear and specific statement of consent
- Specific and ‘granular’ statements to ensure consent is obtained for certain elements of RJ and information sharing within this
- The name(s) of any third-party controllers who will also require consent
- Clear and simple instructions on how to withdraw consent at any time
- A maintained evidence base, on who, when, how and what information has been shared
- How consent will be kept under review and refreshed.
