Restitution Fund: guidance

The power to make a restitution order came into force on 10 February 2021. These orders are a financial penalty available to courts to those convicted of assault on police, under section 90 of the Police and Fire Reform Act 2012. The funding received will provide support services for victims.

Flowchart illustrating restitution fund process starting with court imposing restitution order on offender, followed by offender paying order to Scottish Courts and Tribunals Service (SCTS). SCTS transfers monies to Scottish Government (SG), which reviews applications, informs applicants of outcomes, and issues grants, leading to reports published by Scottish Ministers and provision of support.
