Restitution Fund: guidance

The power to make a restitution order came into force on 10 February 2021. These orders are a financial penalty available to courts to those convicted of assault on police, under section 90 of the Police and Fire Reform Act 2012. The funding received will provide support services for victims.


5. Record-Keeping

5.1 Monitoring arrangements are necessary to ensure that the funding meets the agreed outcomes and is used for its intended purposes.

5.2 In administering the Fund, the Scottish Government will keep records of:

  • every payment made into the Fund,
  • every payment made out of the Fund,
  • the outlays incurred in administering the Fund, and
  • the balance of the Fund.

5.3 The Scottish Government may dispose of these records after six years.
