IG reforms: report back from early engagement with ICO 

  • fortnightly meetings with the ICO
  • ICO in process of drawing up update guidance, but not embracing the phrase/nomenclature of ‘functional anonymisation’
  • ICO in guidance talks with ONS and ADR-UK and RDS would need to align to guidance
  • ICO wish to know more about researcher sanctions and sanctions policy for researchers who breach guidelines
  • RDS more immediate focus is on IG Pathway One, development of pathway two to follow at a slower pace

Action one: 

  • the IG project group/task and finish group being set up to rationalise/dissect ICO response 

IG reform: feedback from engagement with public panel

  • value seen
  • overall clarity of oversight – does RDS need an oversight body?
  • considered low risk
  • panel not comfortable with IG pathway two approach
  • RDS must help public understand benefit/risk

Action two:

  • articulate the benefits of the IG approach in a ‘friendly’ comms piece to be circulated by correspondence

Streamlined IG pathway two – options paper presented by MacRoberts

  • the four options outlined in the paper are introduced 
  • paper is the starting point to kick of conversations
  • the difference between RDS and another data controller becoming the lead controller is legally similar
  • regarding veto rights, there is no change to what is being done to the data, an advisory board would oversee any changes
