21 Where prior notification/prior approval is required, a developer or landowner must submit a prior notification before starting any work on the development and must not start this work until either the planning authority responds to the prior notification within 28 days to confirm that prior approval is not required; or the 28 day period expires with no response from the planning authority; or where the planning authority indicates prior approval is required, such approval is granted. The developer or landowner must carry out the work in accordance with the details supplied in the prior notification or, where appropriate, as detailed in the prior approval. Where the authority has indicated that prior approval is required and subsequently consider that the proposal cannot be made acceptable by changes to the relevant matters under consideration, they may refuse the application. Where prior approval is required, it can be granted with or without conditions

153 Sites of archaeological interest encompass Scheduled Monuments, land designated as an area of archaeological importance, and sites which have been included in a Sites and Monuments Record (usually now termed a Historic Environment Record) held by any local authority before 13 March 1992.

154 Section 59 of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997 places a general duty on planning authorities and the Scottish Minsters when exercising planning functions in relation to listed buildings. Subsection (1) states: “In considering whether to grant planning permission for development which affects a listed building or its setting, a planning authority or the Secretary of State, as the case may be, shall have special regard to the desirability of preserving the building or its setting or any features of special architectural or historic interest which it possesses.”

155All listed buildings in Scotland, regardless of category, are protected both externally and internally. This protection includes any object or structure physically attached to the building, as well as associated features such as boundary walls, gates, gate piers, and outbuildings. Under the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997, listed building consent is required for any works involving the demolition of a listed building, or its alteration or extension in a way that would affect its character as a building of special architectural or historic interest.
