National Care Service: Human Rights and the Charter

This is a supporting document for the National Care Service Charter of Rights. It describes some of the human rights that are engaged by social care, social work and community health and explains how these rights are reflected in the Charter.


2. A human rights based approach

The Scottish Government are committed to embedding human rights across its policy making, decision-making and delivery.

Taking a human rights based approach is about making sure that people's rights are at the centre of everything. The approach aims to makes sure both human rights principles and standards are integrated into policy, planning, service delivery, and evaluation.

The approach aims to:

  • empower individuals and communities to claim their rights
  • increase the ability and accountability of duty bearers to uphold rights

The PANEL principles provide a practical guide for implementation of a human rights based approach. The principles are participation, accountability, non-discrimination, empowerment, and legality.

The table in Annex 1 sets out how the PANEL principles have been applied to the process of developing the Charter and to the outcomes the Charter can deliver when implemented.
