Mental Health (Care and Treatment) (Scotland) Act 2003 Remedial Order 2026: interim equality impact assessment
Interim equality impact assessment (EQIA) on the Order to amend the Mental Health (Care and Treatment) (Scotland) Act 2003, to extend the ability to specify "recorded matters" to patients subject to a Compulsion Order, Compulsion Order with Restriction Order, Hospital Direction and Transfer for Treatment Direction.
The Scope of the EQIA
Protected characteristics that have been initially assessed are age, disability, sex, race, religion/belief, sexual orientation, gender reassignment, pregnancy/maternity.
Methods included analysis of legislation and review of national statistics and monitoring reports. Scottish Ministers are conducting a targeted consultation on the proposed changes to the 2003 Act. Stakeholders will be offered meetings following the consultation closing. The consultation will last from 23 January till 23 March 2026.
