When section 36 consent is required
Section 36 consents are required to construct, operate or extend a generating station in the territorial sea adjacent to Scotland (0-12 nm) where the generating capacity is in excess of 1 megawatt (MW) or in the Scottish part of the Renewable Energy Zone (12-200 nm) where the generating capacity is in excess of 50 MW.
