Marine consenting: Section 36 consent
Guidance on section 36 consent requirements for offshore renewable energy generating stations.
How to apply
An application letter, which must describe, by reference to a map, the place where the generating station is proposed to be constructed, extended or operated, should be sent to MD-LOT.
Applications for section 36 consent should be made at the same time as an application for a marine licence for the construction of the generating station (works), as they are likely to be considered at the same time.
Applicants are required to submit sufficient information to support their applications for section 36 consent to enable Scottish Ministers to make a determination. For section 36 consent, this may include information required as a result of Environmental Impact Assessment , Habitats Regulations Appraisal and Marine Protected Area assessment. Further information on application requirements and supporting information can be found in marine licensing and consenting: offshore renewable energy projects.
An invoice for the application fee will be issued when an application is received by MD-LOT and initial checks have been carried out. The invoice will provide information on accepted methods of payment. Payments should reference the invoice number to allow the payment to be processed efficiently and to prevent delays. Application fees must not be sent with applications prior to receiving an invoice.
