Hate crimes with a transgender aggravator: FOI release

Information requested

Hate crimes with a transgender aggravator could you please give annual totals from when the Offences (Aggravation by Prejudice) (Scotland) Act 2009 came into force, to the most recent year available, for the following categories:

  • number of reports made alleging a crime
  • number of recorded crimes
  • number of charges
  • number of court proceedings
  • number of convictions by gender and crime type

While our aim is to provide information whenever possible, in this instance the Scottish Government does not have some of the information you have requested as we do not hold the information. We have provided links to external website where the data is held where possible.

The number of reports made alleging a crime is not held by the Scottish Government. Police Scotland publish quarterly management information including the number of reports with a hate concern. This is available here: https://www.scotland.police.uk/about-us/what-we-do/how-we-are-performing/. However, you may wish to contact Police Scotland at foi@scotland.police.uk who may be able to help you further with this request.

The number of police recorded hate crimes with a transgender identity aggravation from 2014-15 to 2019-20 is provided in the attached spreadsheet. The number of hate crimes by aggravator presented in the spreadsheet is higher than the figures provided in Table 6 of Characteristics of police recorded hate crime in Scotland: study, published in February 2021. This is because the data in the spreadsheet also includes hate crimes that have multiple aggravations. Table 6 in the published study presents hate crimes with one/single aggravator separately from those with multiple aggravators. A second study into the characteristics of police recorded hate crimes in Scotland is due to be published in 2022. 

The number of charges is not held by Scottish Government. The Crown Office & Procurator Fiscal Service publish this information here: https://www.copfs.gov.uk/publications/equality-and-diversity.

The Scottish Government Criminal Proceedings database is not a live system and the latest available information is for the financial year 2019-20. In the attached spreadsheet, the statistics are presented on the number of people dealt with by the Scottish Criminal Justice System where proceedings have concluded, rather than the number of charges or court proceedings.

Information for 2020-21 will not be available until publication of the Criminal Proceedings in Scotland, 2020-21 Statistical Bulletin. This is due to be published later this year.
