Information request and response under the Environmental Information (Scotland) Regulations 2004.
Information requested
We are making a request under the above Act for information relating to the A82 between Inveruglas and Ardlui in October 2024. In particular, we require the following information: -
Information including sight of any written or electronic communication detailing all road maintenance tasks undertaken to the A82 road at or in close proximity to the Pulpit Rock Viaduct from 1 October 2024 to 31 October 2024.
Information including sight of any written or electronic communication detailing any road resurfacing or dressing works undertaken to the A82 road at or in close proximity to the Pulpit Rock Viaduct from 1 October 2024 to 31 October 2024.
Information including sight of any written or electronic communication detailing any high friction dressing resurfacing or renewal works undertaken to the A82 road at or in close proximity to the Pulpit Rock Viaduct from 1 October 2024 to 31 October 2024.
Information including sight of any written or electronic communication detailing the installation, repair, renewal of or replacement of the Britflex BEJ 10 Nosing Joints to the A82 road at or in close proximity to the Pulpit Rock Viaduct from 1 October 2024 to 31 October 2024.
Response
As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.
This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.
Q1. You requested Information including sight of any written or electronic communication detailing all road maintenance tasks undertaken to the A82 road at or in close proximity to the Pulpit Rock Viaduct from 1 October 2024 to 31 October 2024.
A1. Transport Scotland's Operating Company, BEAR Scotland, advise there are no records of any Routine Maintenance, Road Safety or Minor Improvements at A82 road at or in close proximity to the Pulpit Rock Viaduct from 1 October 2024 to 31 October 2024 having been undertaken.
Q2. You requested Information including sight of any written or electronic communication detailing any road resurfacing or dressing works undertaken to the A82 road at or in close proximity to the Pulpit Rock Viaduct from 1 October 2024 to 31 October 2024.
A2. Please See Annexes A - D to this response for Information including sight of any written or electronic communication detailing any road resurfacing or dressing works undertaken to the A82 road at or in close proximity to the Pulpit Rock Viaduct from 1 October 2024 to 31 October 2024.
An exception under regulation 11(2) of the EIRs (personal information) applies to some of the information requested because it is personal data of a third party and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exception is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.
Q3. You requested Information including sight of any written or electronic communication detailing any high friction dressing resurfacing or renewal works undertaken to the A82 road at or in close proximity to the Pulpit Rock Viaduct from 1 October 2024 to 31 October 2024.
A3. Transport Scotland's Operating Company, BEAR Scotland, advise that no High Friction works have been carried out in the area of the A82 Pulpit Rock from 1 October 2024 to 31 October 2024.
Q4. You requested Information including sight of any written or electronic communication detailing the installation, repair, renewal of or replacement of the Britflex BEJ 10 Nosing Joints to the A82 road at or in close proximity to the Pulpit Rock Viaduct from 1 October 2024 to 31 October 2024.
A4. Transport Scotland's Operating Company, BEAR Scotland, advise that their Bridges Team have no record of any installation, repair, renewal or replacement of the expansion joints on this structure in October 2024.
