Correspondence between West Lothian Council and Scottish Government regarding toilet provision for schools: FOI release

Information requested

Paragraph 69 of the following judgment stated that West Lothian Council wrote to the Scottish Ministers on 03 February 2026 seeking the removal of single-sex sanitary accommodation in the School Premises Regulations 1967, and the Ministers wrote to the Council on 25 March 2026.

Please provide both these letters and any other correspondence between the parties relating to school toilets or the School Premises Regs.

The information you have requested can be found within the annex. We have provided all correspondence exchanged directly between West Lothian Council and Scottish Ministers relating to school toilets or the School Premises Regulations 1967, in line with your request.

However, while our aim is to provide information whenever possible, in this instance, we are unable to provide some of the information you have requested because an exemption under section 38(1)(b) of FOISA applies to some of the information you have requested as it relates to personal data. This exemption is not subject to the ‘public interest test’, therefore, we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
