Recorded information regarding the Joint Council for Cosmetic Practitioners: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002.


Information requested

Please provide the following recorded information for the period 1 January 2018 to 31 March 2026:

1. Any records assessing, checking, discussing or describing the JCCP’s legal status as a voluntary register, charity, self-regulatory body, stakeholder body, representative body, or nonstatutory body.
2. Any records assessing, checking, discussing or describing whether the JCCP was a statutory regulator or had any statutory regulatory powers.
3. Any records assessing, checking, discussing or describing the limits of PSA accreditation of the JCCP register.
4. Any records assessing, checking, discussing or describing JCCP governance, trustee interests, funding arrangements, commercial links, conflicts of interest, independence, or connected-party relationships.
5. Any records assessing, checking, discussing or describing whether the JCCP was representative of the wider non-surgical cosmetic sector, including independent practitioners, beauty therapists, non-healthcare practitioners, or non-medical practitioners.
6. Any records showing whether Scottish Government officials or ministers considered it necessary to carry out due diligence on JCCP before engaging with it in relation to non-surgical cosmetic procedure regulation, licensing proposals, stakeholder engagement, consultation, impact assessment, or bill development.

Information we hold on your questions has already been released and subsequently published under previous FOI requests detailed below. This information is publicly available. Under section 25(1) of FOISA, we do not have to give you information which is already reasonably accessible to you. If, however, you do not have internet access to obtain this information from the website(s) listed, then please contact me again and I will send you a paper copy. In each case I have considered and I am comfortable that, even if there are differences between your request and the previous published request the information released is appropriate and comprehensive. I am also satisfied that in each case the relevant information is reasonably accessible to you within those published releases.

Insofar as material of any description in this request is not to be found in the resources provided please take this as formal notice, under section 17(1) of FOISA that such material is not held by the Scottish Government.

Question 1 and 2

You have requested information that has already been published. All information in relation to question 1 and 2 that the Scottish Government holds is at:

Question 3

Information in relation to question 3 that the Scottish Government holds is at Annex 1 at

A further search found information which is at Annex 1 of this letter. While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under sections s.38(1)(b) of FOISA applies to that information.

This is because some of this information is personal data of third parties, e.g. names/contact details of individuals, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption. Exemptions under section 38(1) (b) have been simply marked as ‘[Redacted - S.38(1)(b)]' throughout the Annex.

Question 5 and 6

The Scottish Government does not have the information you have asked for. JCCP is one of many stakeholder organisations and individuals that Scottish Government has engaged with in developing the Non-surgical Procedures and Functions of Medical Reviewers (Scotland) Act and The Civic Government (Scotland) Act 1982 (Licensing of Non-surgical Procedures) Order 2026. JCCP were consulted due to their role and expertise in operating a not for profit practitioner register accredited by the Professional Standards Authority as part of its Accredited Register Programme.

As such, I hereby provide you with formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested.
