Information request and response under the Freedom of Information (Scotland) Act 2002.


Information requested

Given recruitment for the below positions were undertaken by the Scottish Government / HM Civil Service in Scotland, and are presently publicly funded positions paid by HM Civil Service in Scotland and sponsored by the Scottish Government Directorate for Justice, please may I request under the relevant information rights regime the following

1. The Job Descriptions / Role profiles (either at the time of public recruitment, or subsequent versions such as they may be available)

a. The Lord Lyon King of Arms

b. The Lyon Clerk and Keeper of the Records

Response

I enclose a copy of all of the information you requested that we hold.

Exemptions under section 38(1)(b) of FOISA applies to some of the information you have requested. Information was also redacted on p8 of the attached documents because it falls out of scope of the request made.

Section 38(1)(b) – Personal data of a third party

Justification:

Disclosure would breach data protection principles as the individuals are not senior public officials. Personal data is exempt from disclosure if disclosure would contravene any of the data protection principles in Article 5(1) of the UK GDPR and in section 34(1) of the DPA 2018. This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
