Minutes related to meeting about infection-related deaths at the Queen Elizabeth University Hospital: FOI Review

Information request and response under the Freedom of Information (Scotland) Act 2002.

Information requested

Original request 202600510226

Any, and all, notes, minutes, or transcriptions taken related to the online meeting involving the First Minister John Swinney and families affected by infection-related deaths at the Queen Elizabeth University Hospital, on Thursday, 5 March 2026.

Response

I have been asked to re-examine your request, to decide whether the original response should be confirmed, with or without modifications, as appropriate, or a fresh decision be substituted. I can confirm that I was not involved in the handling or decision-making around the original response. I have considered this case again, and have conducted a comprehensive review of the response.

In accordance with section 21(4) of FOISA, I have reached a decision on your request.

I have concluded that a different decision should be substituted.

As part of this review, I considered the exemptions and the application of the public interest test. I have concluded that, on balance, the public interest lies in favour of disclosing the information, as part of open, transparent, and accountable government.

As such, I enclose a copy of some of the information you requested. Part of this document is subject to redactions under section 38(1)(b) of FOISA. Please note, that the information released to you is considered a draft, and may be subject to future revision and amendment.

An exemption under section 38(1)(b) of FOISA (personal information) applies to a small amount of the information requested because it is personal data of a third party, i.e. names of private  individuals, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018.

This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
