Information request and response under the Freedom of Information (Scotland) Act 2002.
Information requested
All information, documentation correspondence (internal and external) held by by the Scottish Government regarding the creation, drafting, and finalisation of the Clinical Governance Standards (available at: https://www.healthcareimprovementscotland.scot/publications/clinical- governance-standards/).
Specifically, this request includes:
- All correspondence (including emails, letters, and meeting invites) sent or received by Scottish Government officials, professional advisors, or ministers who were involved in the creation, review, or approval of these standards.
- Meeting notes, memos, draft versions of the standards, impact assessments, and records of opinions held internally within the Scottish Government concerning the development of these standards.
- All formal and informal communication between the Scottish Government and Healthcare Improvement Scotland, as well as any correspondence with external stakeholders (such as professional or academic bodies like Royal Colleges or NAIT) that informed the Scottish Government’s input into these standards.
Response
I enclose a copy of some of the information you requested.
While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption(s) under section(s) s.30 (b)(i) - free and frank provision of advice, s.30 (b)(ii) - free and frank exchange of views, s.38 (1)(b) - personal information, s.12 (1) - complying will exceed upper cost limit of FOISA applies to that information.
Exemptions S.30 (b)(i), S.30 (b)(ii) and S38 (1)(b) apply to the answers provided for questions one and three.
While our aim is to provide information whenever possible, in this instance the costs of locating, retrieving and providing the information requested would exceed the upper cost limit of £600. The reason this exceeds the upper limit is due to the size of the documents within scope of your request and the work required to ensure any document(s) released comply with FOISA regulations. Under section 12 of FOISA public authorities are not required to comply with a request for information if the authority estimates that the cost of complying would exceed the upper cost limit, which is currently set at £600 by Regulations made under section 12.
You may, however, wish to consider reducing the scope of your request in order that the costs can be brought below £600. Clarifying the specific information you are interested in viewing on the draft versions of the standards may allow us to fulfil your request (for question 2).
