Information requested

Please provide me with all correspondence between Scottish Government and NHS Greater Glasgow and Clyde regarding water ingress in Ward 4B at the QEUH, which is the bone marrow transplant unit, also called Haemato-oncology, sent within the last six months. (September 2025 - today).

I enclose a copy of most of the information you requested in Annex A.

Please note that whilst no information was available as requested in your ask under reference 202600509209, much of the information shared in this response was instigated by the first minister/his staff or health secretary/his staff.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section 38(1)(b) (personal information) of FOISA applies.

This is because it is personal data of a third party, i.e. names and contact details of individuals, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data
Protection Regulation and in section 34(1) of the Data Protection Act 2018.

This exemption is not subject to the ‘public interest test’, so Scottish Ministers, special advisers and the Permanent Secretary are covered by the terms of the Lobbying (Scotland) Act 2016. See www.lobbying.scot

I have also applied an exemption under Section 30 of the Freedom of Information (Scotland) Act 2002 (FOISA) which exempts information from disclosure where disclosure would, or would be likely to:

(ii) inhibit substantially the free and frank provision of advice

(iii) inhibit substantially the free and frank exchange of views for the purposes of deliberation

My reasons for applying this exemption are much of the wider content found in our searches is not relevant to your request and, I have taken the view that to release it would breach the freedom  of both parties to discuss an ongoing situation and potentially affect future policy development. Subjecting this to the ‘public interest test’ on balance it is not in the interest of the public to release it.
