Information requested
1. Could you supply all documentation held by the Scottish Government, including correspondence sent and received (including internal), minutes/notes from meetings, briefing, analysis, to/from or mentions Scottish Trans from last month?
2. Could you supply all documentation held by the Scottish Government, including correspondence sent and received (including internal), minutes/notes from meetings, briefing, analysis, about rent controls, from the last month?
Response
I will respond to each part of your request individually and as numbered above.
1. Some of the information you have requested is available online. Under section 25(1) of FOISA, we do not have to give you information which is already reasonably accessible to you. If, however, you do not have internet access to obtain this information from the website(s) listed, then please contact me again and I will send you a paper copy.
While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemptions under section(s) under section(s) s.29(1)(a) (policy formulation), s.38(1)(b) (personal information), s.30 (b)(i) (provision of advice), s.30 (b)(i) (free and frank exchange of views) and s.30 (c) (likelihood to cause substantial prejudice) of FOISA applies to that information. The reasons why that exemption(s) applies are explained in the Annex to this letter.

2. While our aim is to provide information whenever possible, in this instance the costs of locating, retrieving and providing the information requested would exceed the upper cost limit of £600. Under section 12 of FOISA public authorities are not required to comply with a request for information if the authority estimates that the cost of complying would exceed the upper cost limit, which is currently set at £600 by Regulations made under section 12.
You may, however, wish to consider reducing the scope of your request in order that the costs can be brought below £600. Revising the scope of your request to focus on a reduced timeline of information considered in relation to the rent freeze might help us to assist you with your enquiry in a cost compliant basis.
