Information requested
When level two Disclosure cases have conviction requiring review, how long does this process take. I require an average time frame and longest and shortest periods from last 3 months.
How many reviews, at level 2 , were requested in last 3 months.
What percentage of those reviews were successful in having disclosed convictions removed?
Response
From 1 April 2025, Level 2 disclosure applicants can ask Disclosure Scotland, acting on behalf of Scottish Ministers, to review whether certain convictions should be included in their disclosure. When an applicant applies for a review, Disclosure Scotland must invite them to provide representations within 28 days to help it reach a decision. Disclosure Scotland may also request information about reviewable conviction(s) from other organisations such as the Scottish Courts and Tribunals Service to help inform its decision.
I have answered each of your questions below. Calculations are based on data between 10 October and 10 December 2025.
1. When level two Disclosure cases have conviction requiring review, how long does this process take. I require an average time frame and longest and shortest periods from last 3 months.
The average length of time it took Disclosure Scotland to complete a review between 10 October and 10 December 2025 is 26 working days.
The longest length of time was 46 days, and the shortest was 4 days.
2. How many reviews, at level 2 , were requested in last 3 months.
Between 10 October and 10 December 2025, Disclosure Scotland received 91 applications for a review of removable convictions.
3. What percentage of those reviews were successful in having disclosed convictions removed?
Between 10 October and 10 December 2025, Disclosure Scotland decided not to include the conviction(s) eligible for review in a Level 2 disclosure in 70% of applications following review.
