Information requested

You asked “ Please supply data on:

1. The proportion of Scottish Government staff identified themselves on the internal HR system as transgender or with a trans history on 31 March 2025.

2. The proportion of Scottish Government staff currently have identified themselves on the internal HR system as transgender or with a trans history.

3. The declaration rate for transgender identity or history on 31 March and currently.

You also asked;

4. If figures require suppression and cannot be provided, is the proportion of staff identifying as transgender or with a trans history lower or higher currently than on 31 March 2025.

Response

Queries 1 and 2

While our aim is to provide information whenever possible, in this instance we are unable to provide [some of] the information you have requested.

An exemption under section s.38(1) Personal Information of FOISA applies to the information you have requested. Section 38(1)(b) can be applied when disclosure of the information requested would contravene the data protection principles in Article 5(1) of the GDPR. We have determined that providing data in response to queries 1 and 2 above as at those specific dates could result in the release of personal information about identifiable individuals due to existing and upcoming Official Statistics. This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

Please note that this publication will next be updated in March 2026 to include data from 31 December 2025. Under section 25(1) of FOISA, we do not have to give you information which is already reasonably accessible to you. If, however, you do not have internet access to obtain this information from the website(s) listed, then please contact me again and I will send you a paper copy.

I enclose some information on the declaration rate for transgender identity or history on both 31st March 2025 and on the 30th September 2025. This represents the latest available data

Query 4

The proportion of staff identifying as transgender or with a trans history as of 30 September 2025 is lower than on 31 March 2025.
