Information request and response under the Freedom of Information (Scotland) Act 2002


Information requested

Information held by the Scottish Government regarding the Mental Health & Policing Partnership Delivery Group for the period 1 January 2022 – present:

1. All minutes, including draft and final versions.

2. All papers circulated to the group (briefing notes, updates, presentations, risk registers, problem profiles, or analysis papers).

3. All action logs and decision logs.

4. Any correspondence between the Scottish Government and Police Scotland relating to:

  • mental-health-related demand
  • repeated crisis callouts
  • pressures arising from early release or high-risk individuals with complex needs
  • the development, implementation, or evaluation of “Right Care, Right Person” or any equivalent Scottish model.

Response

In regard to question 1 - 3 as set out above, I enclose a copy of most of the information you requested.

Whilst our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because of an exemption under the following regulations:
Section 38(1)(b) - Personal information

Section 30(b)(ii) – free and frank exchange of views

Section 29 (1)(a) – Formulation or development of Scottish Government policy

The reasons why these exemptions apply are explained in ANNEX A to this letter.

In regard to request 4 as set out above, the costs of locating, retrieving and providing the information requested would exceed the upper cost limit of £600. While our aim is to provide information whenever possible, mental health and policing is a key area of focus for the Scottish Government and we communicate very regularly with Police Scotland regarding this. As such, there is an extensive amount of correspondence from various policy areas across the Scottish Government relating to the topics you have outlined in this question. Section 12 of FOISA states public authorities are not required to comply with a request for information if the authority estimates that the cost of complying would exceed the upper cost limit, which is currently set at £600 by Regulations made under section 12.
