Correspondence relating to Tong Park housing scheme: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002.


Information requested

For TIG (Tighean Innse Gall) scheme with Calmax Construction Ltd in Lewis at Tong Park:

1. any and all documentation and communications relating to the scheme.

2. the contract agreed to by TIG (Tighean Innse Gall) for the funding.

3. plans and documents supplied for registration; and

4. any funding or support TIG (Tighean Innse Gall) currently or historically received from the Scottish Government and what the funds were allocated for.

Response

1. Please find attached documentation and communications relating to the Tong Park housing scheme. While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption(s) under section(s), s.38(1)(b) (personal information) of FOISA applies to that information. The reasons why that exemption(s) applies are explained in the Annex to this letter.

2. Please find attached the offer of grant award letter dated 30 January 2013 for the funding. While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption(s) under section(s), s.38(1)(b) (personal information)> of FOISA applies to that information. The reasons why that exemption(s) applies are explained in the Annex to this letter.

3. While our aim is to provide information whenever possible, in this instance the Scottish Government does not have the information you have requested regarding plans and documents supplied for registration. As such, I hereby provide you with formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested as it is not responsible for registering titles for new build New Supply Shared Equity Housing. 4. While our aim is to provide information whenever possible, in this instance the costs of locating, retrieving and providing the information requested would exceed the upper cost limit of £600. While the Scottish Government provides different routes to funding to Tighean Innse gall, this has been for over a thirty-year period, and our records indicate there are thousands of records relating to Tighean Innse Gall. Under section 12 of FOISA public authorities are not required to comply with a request for information if the authority estimates that the cost of complying would exceed the upper cost limit, which is currently set at £600 by Regulations made under section 12.

You may, however, wish to consider reducing the scope of your request in order that the costs can be brought below £600.

You may wish to narrow the request on funding provided to Tighean Innse Gall by the Scottish Government for example by asking about a particular housing development or narrowing the timeframe to a specific period.

Annex A

An exemption applies.

An exemption(s) under section(s) s.38 (1) (b) of FOISA applies to some of the information you have requested. Names of individuals who are below Senior Civil Service or equivalent for external organisations have been redacted as it is personal information.

This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
